House certifies Sara impeachment did not violate Constitution


House prosecutors insist they did not violate the Constitution’s one-year bar rule, the basis for the impeachment court’s decision to remand the complaint against Duterte

MANILA, Philippines – The House of Representatives certified on Wednesday, June 11, that the impeachment proceedings initiated against Vice President Sara Duterte did not violate the 1987 Constitution.

The approval of the resolution in the plenary came hours after the House prosecution panel faced the media to insist that it had strictly followed the charter when it impeached the Vice President.

The impeachment court remanded the case to the House on Tuesday, June 10, after 18 out of 23 senators voted in favor of a motion raised by Senator Bato dela Rosa, an ally of the Dutertes.

Dela Rosa claimed that House deliberately sat on the first three impeachment complaints in December, before approving a fourth complaint in February. He argued that it violated the constitutional one-year-bar rule, which states that only one impeachment proceeding can be initiated against the same official in one year.

In remanding the impeachment articles, the court asked for two things: first, for the House to certify that it did not violate a constitutional rule when it proceeded with the impeachment of the Vice President; second, for the House of the 20th Congress to express willingness that it is still willing to push through with the trial.

The House approved a motion on Wednesday to defer the acceptance of the returned impeachment articles until the Senate provides clarification on its order. – Rappler.com
