Escudero holds briefing after Senate remanded Sara Duterte impeachment to House

Constitutional law experts say the remanding was unconstitutional as it had no legal basis

MANILA, Philippines – Senate President Chiz Escudero holds a press conference on Wednesday, June 11, a day after the Senate, sitting as an impeachment court, remanded the articles of impeachment to the House of Representatives.

A total of 18 senators voted in favor of the motion by Senators Alan Peter Cayetano and Bato dela Rosa to return the impeachment to the lower chamber. Only five voted against it, while no one abstained.

Although the motion did not directly dismiss the impeachment, the Senate minority said the move was tantamount to junking it.

Constitutional law experts said the remanding was unconstitutional as it had no legal basis. University of the Philippines College of Law professor Paolo Tamase said the Senate has no power to return and order the House of Representatives because they observe co-equal status.
