Brooklyn, Mich.-Denny Hamlin admits that 23xi races may have to run as an open team after a three-judge’s decision this week, but said on Saturday that he and co-owner Michael Jordan “very confident in our case for December 1st.”
The panel of judges of the fourth Court of Appeals unanimously ruled to evacuate the preliminary order that enabled 23xi races and front row car sports to compete as chartered teams, despite not signing the charter agreement last year.
23xi Racing and Front Row Motorsports have a petition for rehearsal until June 19 before the entire fourth Court of Appeal. Thursday’s decision only comes into effect until seven days after the expiry of the 23xi Racing and Front Row Motorsports to submit a petition for rehearsal. It would be June 26.
